Acceptance of Terms
By downloading, installing, or using the Arkive mobile application ("App") or visiting arkive-app.netlify.app ("Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
If you do not agree to these Terms, do not use the App or Site. These Terms constitute a legally binding agreement between you and Tribal Ventures, LLC, a Georgia limited liability company ("Company," "we," "us," or "our").
Description of Service
Arkive is a pet care management application that allows users to track pet health records, care schedules, medication logs, reminders, and related information. The App also provides access to AI-powered features including symptom checking, lab result interpretation, vet bill analysis, and allergy insights.
Arkive is intended for personal, non-commercial use to help pet owners organize and manage their pets' care.
Accounts & Eligibility
You must be at least 13 years of age to create an Arkive account. By creating an account, you represent that you meet this requirement.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use at support@arkive-app.com
We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period.
AI Features — Important Limitations
Arkive includes AI-powered features such as the Symptom Checker, Lab Results OCR, Allergy Tracker Insights, and Vet Bill Analyzer. These features are powered by Anthropic's Claude AI.
These AI features are for informational and organizational purposes only. They do not constitute veterinary advice, diagnosis, or treatment. Always consult a licensed veterinarian for any health concerns about your animals. Never delay seeking veterinary care based on information provided by Arkive's AI features.
The Company makes no representations or warranties about the accuracy, completeness, or reliability of AI-generated content. AI outputs may contain errors and should be reviewed critically.
Acceptable Use
You agree to use Arkive only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App for any illegal purpose or in violation of any applicable laws
- Upload content that is defamatory, obscene, or violates third-party rights
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse engineer, decompile, or otherwise attempt to derive the source code of the App
- Use automated tools, bots, or scrapers to access the App
- Interfere with the security or integrity of the App or its servers
- Share your account with others outside your household
Your Content
You retain ownership of all content you upload to Arkive (pet photos, records, notes, etc.). By uploading content, you grant Tribal Ventures, LLC a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the App's services to you.
We do not claim ownership of your content and do not use it for marketing or any purpose beyond operating the App.
You are responsible for ensuring that any content you upload does not violate third-party rights or applicable law.
Intellectual Property
The Arkive name, logo, app design, and all related branding are trademarks of Tribal Ventures, LLC. All rights reserved.
The App's software, code, and content (excluding your uploaded data) are the exclusive property of Tribal Ventures, LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
Disclaimers & Limitation of Liability
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIBAL VENTURES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you have paid nothing).
Termination
You may stop using the App and delete your account at any time from Settings → Delete Account within the App.
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including Sections 7, 8, and 10.
Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Douglas County, Georgia, except that either party may seek injunctive relief in a court of competent jurisdiction.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the App and delete your account.
